5.1.2. \u201ckullan\u0131c\u0131\u201d, Muen Percussion \/veya ba\u015fka bir \u00fc\u00e7\u00fcnc\u00fc \u015fahs\u0131n ayni veya \u015fahsi haklar\u0131na, malvarl\u0131\u011f\u0131na tecav\u00fcz te\u015fkil edecek nitelikteki \u201csite\u201d dahilinde bulunan resimleri, metinleri, g\u00f6rsel ve i\u015fitsel imgeleri, video klipleri, dosyalar\u0131, veritabanlar\u0131, kataloglar\u0131 ve listeleri \u00e7o\u011faltmayaca\u011f\u0131n\u0131, kopyalamayaca\u011f\u0131n\u0131, da\u011f\u0131tmayaca\u011f\u0131n\u0131, i\u015flemeyece\u011fini, gerek bu eylemleri ile gerekse de ba\u015fka yollarla \u201cmuenpercussion.com \u201d sitesi ve Muen Percussion ile do\u011frudan ve\/veya dolayl\u0131 olarak rekabete girmeyece\u011fini kabul ve taahh\u00fct etmektedir.<\/span><\/p>\n

5.2. Muen Percussion \u2019nin Hak ve Y\u00fck\u00fcml\u00fcl\u00fckleri<\/span><\/p>\n

Muen Percussion \u201csite\u201dde sunulan mal ve hizmetleri her zaman de\u011fi\u015ftirebilme; bilgileri ve i\u00e7erikleri \u201ckullan\u0131c\u0131\u201dlar da dahil olmak \u00fczere \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin eri\u015fimine kapatabilme ve silme hakk\u0131n\u0131 sakl\u0131 tutmaktad\u0131r,Muen Percussion bu hakk\u0131n\u0131 hi\u00e7bir bildirimde bulunmadan ve \u00f6nel vermeden kullan\u0131r. \u201cKullan\u0131c\u0131\u201dlar, Muen Percussion \u2019 in talep etti\u011fi de\u011fi\u015fiklik ve\/veya d\u00fczeltmeleri derhal yerine getirmek zorundad\u0131rlar.<\/span><\/p>\n

Bu de\u011fi\u015fiklik ve\/veya d\u00fczeltme istekleri, \u201ckullan\u0131c\u0131lar\u201d taraf\u0131ndan yerine getirilmez ise, gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc takdirde Muen Percussion taraf\u0131ndan yerine getirilebilir. De\u011fi\u015fiklik ve\/veya d\u00fczeltme taleplerinin, kullan\u0131c\u0131lar taraf\u0131ndan zaman\u0131nda yerine getirilmemesi sebebiyle do\u011fan veya do\u011fabilecek zararlardan, hukuki ve cezai sorumluluk tamamen kullan\u0131c\u0131lara aittir.<\/span><\/p>\n

5.2.2. Muen Percussion ,\u201csite\u201d de mevcut bulunan bilgilerin do\u011fruluk ve g\u00fcncelli\u011fini s\u00fcrekli olarak kontrol eder. Ancak g\u00f6sterilen b\u00fct\u00fcn \u00e7abaya ra\u011fmen ilgili bilginin g\u00fcncel durumu ile \u201csite\u201d de yer alan durumu aras\u0131nda farkl\u0131l\u0131k olabilir.Bu ve bunun gibi teknik ve tipografik hata durumlar\u0131nda<\/span>
\n<\/span>Muen Percussion \u2019nin herhangi bir hukuki sorumlulu\u011fu do\u011fmayacakt\u0131r.<\/span><\/p>\n

5.2.3 Muen Percussion \u201dsite\u201dde yer alan \u201c\u015fahsi kullan\u0131c\u0131\u201d bilgilerini veya \u00fcyeli\u011fe ili\u015fkin \u201ckullan\u0131c\u0131\u201d bilgilerini, \u201ckullan\u0131c\u0131\u201d g\u00fcvenli\u011fi ile kendi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ifa ve baz\u0131 istatistiki de\u011ferlendirmeler i\u00e7in kullanabilir. Bunlar\u0131 bir veritaban\u0131 \u00fczerinde tasnif edip muhafaza edebilir.<\/span><\/p>\n

5.2.4 Muen Percussion \u201csite\u201dnin i\u015fleyi\u015fine, genel kurallar\u0131na, genel ahlak kurallar\u0131na ayk\u0131r\u0131, siteyi karalay\u0131c\u0131 ve kabul edilmesi m\u00fcmk\u00fcn olmayan mesajlar\u0131, yorumlar\u0131 istedi\u011fi zaman eri\u015fimden kald\u0131r\u0131r; bu mesaj ve yorumlar\u0131 giren \u201ckullan\u0131c\u0131\u201dn\u0131n \u00fcyeli\u011fine herhangi bir ihbar yapmadan ge\u00e7ici veya s\u00fcrekli son verebilir ve hakk\u0131nda cezai ve hukuki i\u015flem ba\u015flatarak maddi veya manevi tazminat isteyebilir.<\/span><\/p>\n

Muen Percussion \u2018nin \u201cmuenpercussion.com\u201d hizmetleri, \u201c muenpercussion.com \u201d bilgileri, \u201c muenpercussion.com \u201d telif haklar\u0131na tabi \u00e7al\u0131\u015fmalar\u0131, \u201cmuenpercussion.com\u201d ticari markalar\u0131, \u201cmuenpercussion.com \u201d ticari g\u00f6r\u00fcn\u00fcm\u00fc veya \u201csite\u201d vas\u0131tas\u0131yla sahip olunan her t\u00fcr maddi ve fikri m\u00fclkiyet haklar\u0131 da dahil t\u00fcm malvarl\u0131\u011f\u0131, ayni ve \u015fahsi hak, ticari bilgi ve know-how\u2019a y\u00f6nelik t\u00fcm haklar\u0131 sakl\u0131d\u0131r.<\/span><\/p>\n

6.2. S\u00f6zle\u015fme De\u011fi\u015fiklikleri<\/span><\/p>\n

6.2.1. Muen Percussion tamamen kendi takdirine ba\u011fl\u0131 ve tek tarafl\u0131 olarak, uygun g\u00f6rece\u011fi herhangi bir zamanda, i\u015fbu s\u00f6zle\u015fmede de\u011fi\u015fiklikler ve\/veya uyarlamalar yapabilir ve sitede ilan eder. \u0130\u015fbu s\u00f6zle\u015fmenin de\u011fi\u015fen h\u00fck\u00fcmleri, ilan edildikleri tarihte ge\u00e7erlilik kazanacak, geri kalan h\u00fck\u00fcmler aynen y\u00fcr\u00fcrl\u00fckte kalarak h\u00fck\u00fcm ve sonu\u00e7lar\u0131n\u0131 do\u011furmaya devam edecektir.<\/span><\/p>\n

6.2.2. \u0130\u015fbu s\u00f6zle\u015fme, \u201ckullan\u0131c\u0131\u201dn\u0131n tek tarafl\u0131 beyanlar\u0131 ile de\u011fi\u015ftirilemez.<\/span><\/p>\n

6.3. M\u00fccbir Sebepler<\/span><\/p>\n

6.3.1. Hukuken m\u00fccbir sebep say\u0131lan b\u00fct\u00fcn durumlarda, Muen Percussion taraf\u0131ndan, i\u015fbu s\u00f6zle\u015fme ile belirlenen edimlerinden herhangi birini ge\u00e7 veya eksik, gere\u011fi gibi ifa etmeme veya hi\u00e7 ifa etmeme halleri, s\u00f6zle\u015fmeyi gere\u011fi gibi veya hi\u00e7 ifa etmeme hukuki nitelendirmesi i\u00e7erisinde g\u00f6r\u00fclemeyecektir. Bu haller sebebiyle herhangi bir hukuki sorumluluk s\u00f6z konusu olmayacak, herhangi bir tazminat talebi dile getirilemeyecektir.<\/span><\/p>\n

6.3.2. \u201cM\u00fccbir sebep\u201d terimi, do\u011fal afet, isyan, sava\u015f, grev, ileti\u015fim sorunlar\u0131, altyap\u0131 ve internet ar\u0131zalar\u0131, elektrik kesintisi ve k\u00f6t\u00fc hava ko\u015fullar\u0131 da dahil, kanuni h\u00fck\u00fcmlerle korunan b\u00fct\u00fcn sebepler olup fakat bunlarla s\u0131n\u0131rl\u0131 olmamak kayd\u0131yla me\u015fhur ve maruf olaylar dahil olmak \u00fczere \u00f6ng\u00f6r\u00fclmeyen, ilgili taraf\u0131n makul kontrol\u00fc haricinde ve Muen Percussion\u2019nin gerekli \u00f6zeni g\u00f6stermesine ra\u011fmen \u00f6nleyemedi\u011fi ka\u00e7\u0131n\u0131lmaz olaylar olarak yorumlanacakt\u0131r.<\/span><\/p>\n

6.4. Uygulanacak Hukuk<\/span><\/p>\n

\u0130\u015fbu s\u00f6zle\u015fmenin uygulanmas\u0131nda, yorumlanmas\u0131nda ve bu s\u00f6zle\u015fme dahilinde do\u011fan hukuki ili\u015fkilerin y\u00f6netiminde T\u00fcrk Hukuku uygulanacakt\u0131r ve T\u00fcrk Mahkemeleri yetkilidir.<\/span><\/p>\n

6.5. S\u00f6zle\u015fmenin Feshi<\/span><\/p>\n

6.5.1. \u0130\u015fbu s\u00f6zle\u015fme \u201ckullan\u0131c\u0131\u201d, \u201csite\u201dye \u00fcye oldu\u011fu s\u00fcrece y\u00fcr\u00fcrl\u00fckte kalacak ve taraflar aras\u0131 h\u00fck\u00fcm ve sonu\u00e7lar\u0131n\u0131 do\u011furmaya devam edecek, \u201ckullan\u0131c\u0131\u201dn\u0131n \u00fcyelik s\u00fcresinin dolmas\u0131 veya ge\u00e7ici veya kal\u0131c\u0131 olarak \u00fcyeli\u011finin durdurulmas\u0131 hallerinde sona ermi\u015f say\u0131lacakt\u0131r.<\/span><\/p>\n

6.5.2. Muen Percussion \u201ckullan\u0131c\u0131\u201dlar\u0131n i\u015fbu s\u00f6zle\u015fme, ekleri, site i\u00e7inde yer alan kullan\u0131ma, \u00fcyeli\u011fe, mal ve hizmetlere ili\u015fkin benzeri kurallar\u0131 ihlal etmeleri durumunda ve \u00f6zellikle a\u015fa\u011f\u0131da say\u0131lan hallerde s\u00f6zle\u015fmeyi tek tarafl\u0131 olarak feshedebilecek, ve \u201ckullan\u0131c\u0131\u201dlar fesih sebebiyle Muen Percussion \u2018nin u\u011frad\u0131\u011f\u0131 t\u00fcm zararlar\u0131 tazmin etmekle y\u00fck\u00fcml\u00fc olacakt\u0131r:<\/span><\/p>\n

\u201cKullan\u0131c\u0131lar\u201d\u0131n, herhangi bir y\u00f6ntem kullanarak sitenin i\u015fleyi\u015fini manip\u00fcle edecek davran\u0131\u015flarda bulunmas\u0131,<\/span>
